Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Orythemes platform, including our website at orythemes.com and all related services (collectively, the "Service"), operated by:

By using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1. Description of Service

Orythemes provides premium, production-ready themes for Ory Kratos authentication pages and the broader Ory open-source ecosystem. Our Service includes:

• A catalog of purchasable themes for Ory Kratos self-service flows
• Theme file downloads (CSS, React components, configuration files)
• Integration documentation and guides
• A waitlist for early access and product updates

2. Purchases and Payment

Themes are available for one-time purchase. All payments are processed by Lemon Squeezy (Merchant of Record) and Stripe. By completing a purchase, you agree to their respective terms of service.

Refund policy. Because themes are digital products delivered immediately upon purchase, all fees paid are non-refundable except where required by applicable law (including EU consumer protection law, which grants a 14-day withdrawal right for digital content not yet downloaded or streamed).

We reserve the right to modify pricing with at least 30 days' advance notice. Price changes do not affect previously completed purchases.

3. Theme Licence

Upon successful payment, we grant you a non-exclusive, non-transferable, perpetual licence to use the purchased theme in your own projects. This licence is subject to your continued compliance with these Terms.

Permitted uses. You may:

• Use the theme in your own applications (personal or commercial)
• Modify the theme files to suit your needs
• Use the theme in multiple projects belonging to you or your organisation

Prohibited uses. You may not:

• Resell, sublicense, redistribute, or share the theme files with third parties
• Include the theme files in open-source projects or make them publicly available
• Use the theme to create a competing theme product or marketplace
• Claim ownership of the original theme design

Updates. Purchased themes include updates within the same Ory Elements major version window at no additional cost. Updates for new Ory Elements major versions may be offered as separate purchases.

4. Waitlist

By joining our waitlist, you consent to receiving email communications about Orythemes, including product launch announcements and updates. You may unsubscribe at any time using the link provided in every email.

Joining the waitlist does not create a purchase obligation or guarantee availability of any specific theme or pricing.

5. Intellectual Property

All theme designs, code, documentation, and other content made available through the Service are the intellectual property of ProactiveLabs S.R.L. or its licensors and are protected by copyright and other applicable laws.

"Ory", "Ory Kratos", "Ory Hydra", "Ory Elements", and related names are trademarks of Ory Corp. Orythemes is an independent product and is not affiliated with or endorsed by Ory Corp.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Scrape or crawl any portion of the Service by automated means
• Impersonate any person or entity

7. Disclaimer of Warranties

THE SERVICE AND ALL THEMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORYTHEMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Themes are designed and tested against specific versions of Ory Elements. We do not guarantee compatibility with all Ory configurations, custom modifications, or future Ory releases.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ORYTHEMES, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE OR THEMES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

These limitations do not apply where liability cannot be excluded or limited under applicable mandatory law (including EU consumer protection law).

9. Indemnification

You agree to indemnify and hold harmless Orythemes and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of the Service or violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania and, where applicable, the law of the European Union.

Any dispute shall first be subject to informal resolution by contacting us at legal@orythemes.com. If not resolved within 30 days, the parties submit to the exclusive jurisdiction of the competent courts of Bucharest, Romania.

If you are a consumer resident in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated with at least 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance.
